Terms & Conditions

TERMS OF SERVICE AGREEMENT (the "Agreement") is a legally binding contract between COMMUNITY TRANSPORTATION MANAGEMENT, a non-emergency medical transportation provider headquartered in Manchester, New Hampshire, registered as a limited liability company under the laws of the state of New Hampshire ("CTM"), and you, either as an individual or on behalf of an entity ("Client"). This Agreement governs your access to, and use of, CTM's official website (the "Website"), including all associated platforms, channels, mobile applications, or other connected digital assets. If you disagree with any of the terms outlined herein or fail to uphold them, you must not access or use the Website and should immediately cease any such activities. If access is terminated, all relationships between you and CTM will end with no lingering commitments, except for any outstanding payments the Client may owe to CTM for previously engaged services.

1. Intellectual Property

All elements of the Website, unless otherwise specified, belong solely to CTM. This encompasses all source codes, databases, functionalities, software, designs, audio, video, text, images, graphics (collectively called “Content”), and any associated logos or emblems (known as “Marks”). These are protected by U.S. and international copyright, trademark, and other relevant intellectual property rights. The Content and Marks are provided "As-Is" and are strictly for informational and personal use. Any replication, display, distribution, or commercial use of the Website's Content without CTM's explicit written approval is prohibited. Any rights not explicitly granted herein related to the Website, its Content, and Marks remain with CTM.

2. Use of Services

CTM provides non-emergency medical transportation services. The Client agrees to use these services in accordance with all applicable laws, regulations, and CTM's policies. The Client is responsible for ensuring that all information provided to CTM for the purpose of arranging transportation services is accurate and complete.

3. Payment and Fees

The Client agrees to pay all fees associated with the transportation services provided by CTM. Payment terms, including rates and billing procedures, will be specified in a separate agreement or communicated to the Client at the time of service booking.

4. Client Responsibilities

The Client is responsible for providing accurate and complete information necessary for CTM to provide transportation services. This includes, but is not limited to, patient information, pick-up and drop-off locations, and any special requirements or accommodations needed.

5. Limitation of Liabilities

CTM shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of its services. CTM's liability for any direct damages shall be limited to the amount paid by the Client for the services giving rise to the claim.

6. Indemnification

The Client agrees to indemnify and hold harmless CTM, its officers, directors, employees, agents, and affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from the Client's use of CTM's services or violation of these Terms & Conditions.

7. Termination

CTM reserves the right to terminate the Client's access to its services and the Website for any breach of these Terms & Conditions.

8. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of New Hampshire, without giving effect to any principles of conflicts of law.

9. Dispute Resolution

Any disputes arising out of or relating to these Terms & Conditions shall be resolved through binding arbitration in Manchester, New Hampshire, in accordance with the rules of the American Arbitration Association.

10. Changes to Terms and Conditions

CTM reserves the right to update or modify these Terms & Conditions at any time. The Client's continued use of the Website and CTM's services following any changes indicates acceptance of the new terms.
